- Introduction
These Booking Terms and Conditions govern all bookings made with Easy Budget Safaris Ltd (“the Company”, “we”, “our”, or “us”). By making a booking with the Company, the client (“you”, “your”, or “traveller”) acknowledges that they have read, understood, and agreed to these Terms and Conditions.
- Booking Confirmation:
– A booking is considered confirmed only upon receipt of the required deposit and written Final Confirmation Advice from the Company.
– The person making the booking on behalf of a group warrants that they have the authority to accept these Terms and Conditions on behalf of all travellers in the booking.
– The Company reserves the right to decline any booking before the Final Confirmation Advice is issued… We respect every Tourist who gives us an opportunity as long as we agree to pay as requested.
- Deposit and Payment:
– A deposit of the amount specified in the quotation is required to secure a booking.
– The balance of the tour cost must be paid on the date the tour commences as indicated on the booking confirmation or invoice. {No instalment payment requested- Deposit 20% and balance 80% upon arrival}
– All bank charges, transfer fees, and foreign exchange costs are the responsibility of the client unless otherwise agreed in writing.
- Prices and Rates:
– All prices are quoted in the currency stated in the itinerary or invoice.
– Prices are based on current costs and may be subject to change due to:
(a). Government taxes and levies;
(b). Park fee increases;
(c). Fuel surcharges;
(d). Currency fluctuations;
(e). Supplier price adjustments.
– Any increase affecting a confirmed booking will be communicated to the client as soon as reasonably possible.
- Cancellations by the Client based on 20% Deposit.
– All cancellation requests must be submitted in writing for purposes of documentation.
– Cancellation charges may apply as follows:
{a}. All budget safari 50% 0f the deposit paid will be refunded no matter the number of days to departure date… Either its a shared safari or Private Safari.
{b}. For all midrange and Luxury Safari due to contracted Hotels and Safari lodges, cancellation will follow a process… Some lodges do not give a credit note and any amount paid to secure the rooms may not be recovered… 50% will be done on the amount not paid to the third parties… Deposit received will be used to Secure the booking accommodations… Where credit note will be issued 50% of that will be refunded to the client.
– Refunds, if applicable, will be processed after deduction of any expense already incurred by the Company.
- Amendments by the Client
– Requests for changes to confirmed bookings are subject to availability for Midrange and luxury safaris… Budget Safaris we are flexible and ready for any change of dates.
– The Company reserves the right to charge reasonable administrative fees and any additional supplier charges arising from requested amendments. Applies to Midrange and luxury safaris.
- Cancellation or Changes by the Company
– While every effort will be made to operate tours as advertised, the Company reserves the right to modify itineraries when necessary due to circumstances beyond its control. {The Company may change the flow of the itinerary and make sure all safari destinations confirmed are covered}
– If a tour is cancelled by Easy Budget Safaris Ltd, clients will be offered:
{a}. An alternative tour for the same number of days.
{b}. A refund of payments made for services not provided.
– The Company shall not be liable for additional expenses incurred by the client, including airfare, accommodation, visas, or other personal arrangements.
- Force Majeure
The Company shall not be liable for delays, changes, interruptions, or cancellations caused by events beyond its reasonable control, including but not limited to:
– Natural disasters;
– Severe weather conditions;
– Political unrest;
– Strikes;
– Epidemics or pandemics;
– Government actions;
– Road closures or transport disruptions.
In such circumstances, any additional costs resulting from the event shall be the responsibility of the client.
- Travel Documents and Visas
– Clients are responsible for obtaining and carrying valid passports, Visas/ETA, Vaccination certificates, travel insurance documentation, and any other required travel documents.
– The Company accepts no responsibility for denied entry, deportation, or travel disruption resulting from inadequate documentation.
- Travel Insurance
– Personal travel insurance is strongly recommended and may be required for certain tours.
– Insurance should cover:
(a). Trip cancellation;
(b). Medical expenses in case of anything;
(c). Personal accident;
(d). Emergency evacuation;
(e). Personal liability;
(f). Loss or damage of baggage and personal belongings.
- Health and Medical Requirements.
– Clients must disclose any medical condition, disability, dietary requirement, or special need that may affect their participation in the tour.
– The Company reserves the right to decline participation where health or safety concerns cannot reasonably be accommodated.
– Clients participate in tours at their own risk and are responsible for carrying any necessary medications.
- Client Conduct
– Clients must comply with local laws, park regulations, and instructions given by guides, drivers, and tour leaders.
– The Company reserves the right to remove any client whose behaviour:
(a). Endangers others;
(b). Violates local laws;
(c). Causes damage to property;
(d). Interferes with the enjoyment of other travellers.
No refund shall be payable in such circumstances.
- Wildlife and Safari Activities
– Wildlife sightings cannot be guaranteed but the safari guides will always do their best…To them they are always on duty and ready to deliver.
– Participation in safari and adventure activities carries inherent risks.
– Clients acknowledge and accept these risks and agree to follow all safety instructions provided by Easy Budget Safaris Ltd representatives.
- Accommodation and Transportation
– Accommodation providers and transport operators are independent suppliers contracted by Easy Budget Safaris Ltd.
– The Company is not responsible for acts, omissions, or failures of independent suppliers, mostly the accommodation suppliers.
– Accommodation descriptions and photographs are provided in good faith and may differ from actual conditions.
- Limitation of Liability.
– Easy Budget Safaris Ltd shall not be liable for:
(a). Personal injury;
(b). Illness;
(c). Loss of life;
(d). Property damage;
(e). Theft or loss of personal belongings;
(f). Delays or disruptions caused by third parties.
– The Company’s total liability shall be limited to the amount paid by the client for the specific services in question, except where prohibited by law.
- Complaints
– Any complaint must be reported immediately to the guide, tour leader, or Company representative to allow an opportunity for resolution immediately, no filing of complaints as we cannot manage to reverse the tour.
– If unresolved, complaints must be submitted in writing within 30 days of completion of the tour.
– The Company will then act on the complaint and give it a fair verdict…
- Photography and Marketing
– Easy Budget Safaris Ltd may use photographs and videos taken during tours for promotional purposes, this will be done in good faith to increase company sales.
– Clients who do not wish their images to be used must notify the Company in writing before the start of the tour.
- Data Protection and Privacy
– The Company collects and processes personal information only as necessary to administer bookings and provide travel services.
– Personal data will be handled in accordance with applicable data protection laws and the Company’s Privacy Policy.
– Personal data will not be disclosed to other clients or third party without the involvement of the client…
- Governing Law
– These Terms and Conditions shall be governed and construed in accordance with the laws of the Republic of Kenya.
– Any dispute arising from or relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the Kenyan courts.
- Acceptance of Terms.
– By making a booking and/or paying a deposit, the client confirms that they have read, understood, and accepted these Booking Terms and Conditions.
